End User License Agreement

This End User License Agreement (the “Agreement”) is a legal agreement between you (an individual or a legal entity, “you”) and Bithub Team SRL, a company incorporated under the laws of Romania (“Bithub Team”, “we”, “us”), covering the Open Headers software: the desktop application, the browser extensions, the daemon, the command-line tools, the MCP server, and the web application, together with their documentation (collectively, the “Software”).

By installing or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software.

Subject to this Agreement, Bithub Team grants you a non-exclusive, non-transferable, worldwide license to install and use the Software:

3. License Files, verification, and lapse

The Software verifies License Files entirely offline. Self-serve License Files are renewed automatically over a documented, publicly-specified network call; enterprise License Files may be delivered and renewed manually for offline or air-gapped use.

If a subscription lapses or a License File expires, the Software never locks you out and never withholds your data: after a grace period, seat limits revert to the Free Tier for newly provisioned users only. Existing users continue to sign in and existing data remains fully accessible and exportable.

4. Restrictions

You may not, except to the extent a restriction is not permitted by applicable mandatory law (including Articles 5 and 6 of Directive 2009/24/EC on the legal protection of computer programs):

Making the Software available to users within your own organization (including contractors working for your organization) is internal use, not distribution.

5. Ownership

The Software is licensed, not sold. Bithub Team and its licensors retain all right, title, and interest in and to the Software. Your configurations, rules, workspaces, recordings, and all other data you create with the Software are yours; this Agreement grants Bithub Team no rights over them.

6. Third-party components

The Software incorporates third-party open-source components, which are provided under their own license terms. The applicable notices and license texts are distributed with the Software. This Agreement does not limit any rights you hold under those licenses.

7. Privacy

The Software collects no personal data and no user content. The browser extensions, the desktop application, and the command-line tools count anonymous feature usage over a documented, publicly specified payload that is structurally limited to a fixed event vocabulary — it cannot carry URLs, headers, traffic, configurations, or identity — is disclosed in this Agreement, the Privacy Policy, and the product documentation, and can be disabled with a single setting. The daemon, the web application, and the MCP server send no telemetry. All other outbound connections are to documented endpoints (license renewal, update checks, notification manifests) with publicly specified payloads, plus destinations you configure yourself. 8. Updates

The Software checks for updates anonymously and may download an available update in the background; you can turn both off in its settings. A running application is never restarted to apply an update without your action: installation happens when you choose “Update & Restart” or when the application next quits. The command-line tool may replace its own executable between invocations on installations it manages itself (disable with oh autoupdate off); the daemon performs unattended updates only where you have explicitly enabled them. Installations owned by an app store or package manager are updated by that channel. Updates you install are covered by this Agreement unless they are accompanied by a revised agreement.

9. Warranty disclaimer

The Software is provided “as is” and, to the maximum extent permitted by applicable law, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. If you are a consumer, this section does not affect statutory warranty rights that cannot be waived by contract.

10. Limitation of liability

To the maximum extent permitted by applicable law, Bithub Team shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunity, arising out of or related to this Agreement or the Software. Bithub Team’s total aggregate liability shall not exceed the amounts you paid for the Software in the 12 months preceding the event giving rise to the claim, or EUR 50 if you paid nothing. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent (dol) or gross negligence, or for death or personal injury caused by negligence.

11. Term and termination

This Agreement remains in force while you use the Software. It terminates automatically if you materially breach it and do not cure the breach within 30 days of notice. On termination you must stop using the Software and destroy your copies; Sections 5, 9, 10, and 12 survive. A subscription lapse is not a termination — it is handled exclusively by Section 3.

12. Governing law and disputes

This Agreement is governed by the laws of Romania, excluding its conflict-of-law rules. Disputes are subject to the competent courts of Romania. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of your country of residence and may bring proceedings there.

13. General

This Agreement is the entire agreement regarding the Software and supersedes prior agreements on the subject. If a provision is held unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver. You may not assign this Agreement without our consent; assignment as part of a merger or sale of your business is permitted with notice.
